Terms and Conditions of Purchase

1. General

By making a purchase on our website, you agree to the following terms and conditions. These terms are designed to establish a clear and transparent relationship between you, the customer, and us, the seller. We kindly ask that you read them carefully before proceeding with your purchase.

2. Products

2.1 Works of Art

We offer a variety of works of art, some of which are available for immediate purchase, whilst others are produced to order. These pieces may include paintings, sculptures, and other forms of visual art.

2.2 Merchandise Items

In addition to works of art, we offer a range of merchandise items, including but not limited to T-shirts, home décor, books, and other related products.

3. Production and Shipping Times

3.1 Works of Art

3.1.1 Framed Works

Works of art requiring framing will take 30 working days to be ready once the purchase has been made.

3.1.2 Unframed Works

Works that do not require framing will be ready for dispatch between 3 and 7 working days after the order has been placed.

3.2 Merchandise Items

Merchandise items, such as clothing, home décor, books, etc., are dispatched between 5 and 7 working days after purchase, owing to our stock management process, as we are a small, growing company.

3.3 Delivery Times

The additional delivery time depends on the customer’s location and the chosen shipping method. Please note that delivery times may vary.

4. Order Confirmation

After completing your purchase, you will receive a confirmation email containing your order details. It is your responsibility to review this information carefully and to contact us immediately should you find any errors. We shall not be held responsible for errors that are not reported in a timely manner.

5. Cancellations and Returns

5.1 Cancellations

Due to the personalised nature of our pieces and our limited stock management, we do not accept cancellations once an order has been confirmed.

5.2 Returns

We do not accept returns on works of art or personalised items. However, if your piece arrives damaged, we kindly ask that you contact us within 7 days of receipt so that we may arrange a resolution. We may ask you to send us photographs of the damage or defect.

5.3 Returns Procedure

If your return request is approved, we will provide you with detailed instructions on how to return the product. Return postage costs will be covered by us if the product is damaged or defective.

6. Liability

We do not accept responsibility for delays in production or delivery caused by circumstances beyond our control, such as natural disasters, strikes, logistical issues, or unforeseen events.

7. Changes to the Terms and Conditions

We reserve the right to update or modify these terms and conditions at any time without prior notice. Any changes will take effect immediately upon publication on this page. We recommend that you review this page regularly to stay informed of any updates.

Terms and Conditions for the Acquisition of Artwork

1. Care of Artworks

1.1. The buyer undertakes to maintain the artwork in appropriate conditions of preservation, avoiding direct exposure to sunlight, extreme humidity, abrupt changes in temperature, and other factors that may cause deterioration to the piece.

1.2. It is recommended that the artwork be installed and handled by professionals to ensure its integrity.

1.3. The buyer must immediately inform the artist or gallery in the event of any significant damage to the artwork.

2. Availability for Future Exhibitions

2.1. Although the artwork has been sold, the artist reserves the right to request the temporary loan of the piece for future exhibitions or retrospectives.

2.2. The buyer will be notified at least three months in advance regarding any request for a loan for an exhibition.

2.3. All transport, insurance, and handling costs during the temporary loan will be covered by the artist or the gallery organising the exhibition.

2.4. The buyer has the right to decline the request for a loan of the artwork; however, cooperation is encouraged in order to promote the visibility of the artist’s work.

3. Authenticity and Certification

3.1. All works of art sold are accompanied by a certificate of authenticity signed by the artist.

3.2. This certificate must be retained by the buyer as proof of the artwork’s authenticity.

4. Resale of Artwork

4.1. Should the buyer decide to resell the artwork, it is recommended that the artist or gallery be notified in order to register the change of ownership.

4.2. The artist reserves the right of first refusal in the event of the resale of the artwork.

5. Copyright and Reproduction

5.1. The sale of the artwork does not transfer copyright to the buyer. The artist retains all copyright and reproduction rights to the work.

5.2. Any reproduction of the artwork, whether for commercial or personal use, must be authorised in advance by the artist.

6. Transport and Delivery

6.1. The transport and delivery of the artwork will be coordinated by the gallery or the artist, ensuring that they are carried out under optimal conditions for the preservation of the piece.

6.2. The buyer is responsible for any additional transport costs should a special shipping method be required.

7. Returns and Cancellations

7.1. Works of art are not eligible for return or refund, except in cases of significant damage during transport.

7.2. Any cancellation of a purchase must be requested within 7 working days of the transaction, and will be subject to the approval of the artist or gallery.

8. Final Provisions

8.1. Any dispute relating to the acquisition of the artwork will be resolved in accordance with the applicable laws of Mexico.

8.2. These terms and conditions may be updated periodically, and the buyer is advised to review any updates prior to making a new acquisition.
